THE PARTIES TO THIS AGREEMENT ARE:

Whereas The Tutor shall provide tutoring to The Student in the for the (circle all applicable):
Series 6        Series 63       Series 65       Series 26

FEES PAYABLE TO THE TUTOR

Individual hours billed at $50 per hour. 5-hour package for $200 ($40/hr). 10-hour package for $300 ($30/hr). Billable tutoring time includes actual tutoring and travel to and from location of The Student. Tutoring time will be rounded down to 15 minute intervals (1/4 hours) in best interest of The Student.

Fees may change in the future, but fees will not change for The Student for specified term of this contract. All renewals/continuations will be at the same price, not increased.

PAYMENT

For individual 1 hours, payment is to be made upon completion of the lesson

For tutoring packages, minimum of half of the payment will be paid upon or before completion of first session, and remaining payment will be paid upon or before completion of session at half-way mark.

SCHEDULE OF LESSONS

Tutoring shall commence on the __________________day of ___________________ 20____ and thereafter at the following times:

CANCELLATION OF LESSONS BY STUDENT

The Student may cancel a meeting by giving at least 48 hours prior notice to The Tutor in which case no deduction of hours will be incurred. For lessons canceled between 24 and 48 hours, half of the time will be billed. Lessons canceled with less than 24 hours’ notice will incur full payment, unless another student is available to fill the slot. Medical, and family emergencies are exempt. _________ (Initialed by The Student)

CANCELLATION OF LESSONS BY TUTOR

The Tutor may cancel lessons by giving 24 hours’ prior notice to The Student in which case no fees shall be incurred. Where a lesson was pre-paid, The Tutor shall reschedule the appointment at a time agreeable to both parties, failing which The Student shall be credited the hours for the lesson. Medical, and family emergencies may have less than 24-hour notice.

LATE ARRIVAL

Fees are calculated according to the times stipulated in the schedule and no adjustment shall be made for time lost because of late arrival by The Student. _________ (Initialed by The Student)

Any lost time because of the late arrival of The Tutor shall be compensated for by extending a lesson by mutual agreement and by such amount of time that was lost.

OBLIGATIONS OF THE TUTOR

* The Tutor undertakes to do all preparation prior to lessons and to structure lessons in such a way as to optimize time to the benefit of The Student.

* The Tutor shall keep confidential all confidential information of The Student but can share progress and results with upline RVP.

* The Tutor shall not assign any of his duties or obligations under this tutoring contract to a third party without the written permission of The Student.

OBLIGATIONS OF THE STUDENT

* The Student agrees to assist The Tutor in identifying problem areas in which The Student needs tutoring.

* The Student agrees that assignments, exercises or homework form an integral part of tutoring and undertakes to complete such work timeously.

TRANSFERRING CREDIT AND REFUNDS

Students who buy packages may transfer credit to take another option of teaching that The Tutor offers or may request a refund. The credit or refund is calculated based on deposit and hours used. The hours are deducted from the deposit at the next lower rate ($30 to $40, $40 to $50), and the remaining balance may be transferred in credit towards another educational option or refunded.

With transferring The Tutor may give additional credit that would not be applicable to a refund.

NO WARRANTIES

The Tutor makes no promises or warranties with regards to a Student’s performance as a result of any tutoring provided.

STATUS OF THE TUTOR

It is expressly understood that The Student retains the services of The Tutor as an independent contractor and not as an employee. The Tutor shall be responsible for his insurance and for all statutory declarations and contributions with regard to income tax.

TERMINATION

This contract may be terminated by either party. The Student terminating the contract while still having a credit, please see Transferring Credit and Refunds. The Tutor terminating the contract results in full refund stipulated in Transferring Credit and Refunds.

RELAXATION OF TERMS

No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.

WHOLE AGREEMENT

This agreement constitutes the entire understanding between the parties with regard to the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein. Any alteration to this agreement must be in writing and signed by both parties.
